Consolidarea fiscală este marea provocare a orizontului de referință 2022 – 2025, arată Ministerul de Finanțe în documentele care fundamentează bugetul pentru anul viitor.
Auzim deja de câțiva ani cât de importantă este consolidarea fiscală pentru finanțele publice și pentru stabilitatea macroeconomică. Deocamdată, măsurile concrete au fost sporadice, situație motivată de incertitudinea celor aproape doi ani de pandemie care au impus pachete de susținere financiară din partea statelor pentru companii și populație. Contextul sanitar a suspendat temporar procesul de consolidare fiscală. Dar ce înseamnă și ce impact are acest proces asupra taxelor?
Scopul consolidării fiscale este reducerea deficitului bugetar sub plafonul de 3% din PIB. Pentru a-l atinge, guvernul și-a asumat prin Planul Național de Redresare și Reziliență (PNRR) o creștere a veniturilor fiscale, adică a încasărilor din taxe și impozite, de 3% din PIB până la finalul aplicării PNRR. Remarcabil este, însă, că această majorare ar urma să fie obținută preponderent dintr-o mai bună colectare a taxelor și impozitelor existente, respectiv 2,5% din PIB, în vreme ce 0,5% ar trebui să vină dintr-o reașezare a sistemului de taxare actual, prin eliminarea unor facilități, scutiri, distorsiuni. Prin urmare, miza pe termen scurt este eficientizarea ANAF. Fără a puncta exact în PNRR care sunt acele prevederi din Codul fiscal care vor fi modificate, Ministerul de Finanțe a lăsat practic o marjă de manevră foarte mare în care poate acționa până la finalul anului 2022 când s-a angajat să publice o analiză a sistemului fiscal și modificările legislative care vor fi făcute în 2023, cu implementare etapizată. Așadar, avem o veste bună: schimbările imprevizibile care au bulversat ani la rândul mediul de afaceri nu ar mai fi posibile. Cu toate acestea, în contextul formării unei noi coaliții de guvernare la sfârșitul lui 2021 și, în pofida angajamentelor din PNRR, au fost resuscitate în dezbaterea publică teme vechi care fuseseră abandonate la momentul inițial al propunerii lor tocmai pentru că nu garantau nicio eficiență din perspectiva consolidării fiscale, dar aveau potențial să afecteze negativ climatul economic – impozitul progresiv, taxa de cifra de afaceri, declarația de avere depusă de către toți cetățenii etc. Aceste idei au fost receptate cu îngrijorare de către companii. În sondajul HR Barometru, efectuat de PwC România la mijlocul lunii decembrie, 65% dintre respondenți spuneau că impozitul progresiv este propunerea fiscală care le-ar afecta business-ul cel mai mult, iar 35% menționau taxa de solidaritate. Este o axiomă că majorarea taxelor într-o perioadă incertă, de criză reprezintă un mare risc pentru revenirea economiei și chiar dacă aceste inițiative au rămas, din fericire, la stadiul de discuție, simpla lor vehiculare în spațiul public influențează negativ percepția afacerilor. Totuși, potrivit aceluiași sondaj, 50% dintre respondenți spun că perspectivele de business pentru 2022 sunt mai bune decât în 2021, 46% că sunt similare și doar 4% că sunt mai slabe.
Măsuri fiscale în PNRR pentru 2022
Știm că percepția companiilor este decisivă pentru evoluția economiei în anul viitor și dacă guvernul va urma planul de măsuri din PNRR va reuși să asigure predictibilitatea mult dorită de mediul de afaceri și în privința taxării. Așa cum spuneam, conform PNRR, va fi făcută o analiză a sistemului fiscal care va fi publicată în ultimul trimestru din 2022 și care se va concentra pe: eliminarea graduală a stimulentelor fiscale și breșelor din legislație în ce privește taxarea veniturilor, taxarea companiilor contribuțiile sociale și taxele pe proprietate (taxe locale) trecerea către o “fiscalitate verde” Măsurile vor fi transpuse în legislație gradual până în ianuarie 2024, iar unele dintre ele vor fi implementate efectiv până în 2028. De exemplu, stimulentele fiscale pentru angajații din construcții vor fi retrase gradual începând din 2025 și vor fi complet eliminate până la final de 2028.
Pentru 2022, prin PNRR guvernul își asumă că va intra în vigoare legislația care face obligatorie înrolarea în SPV a tuturor contribuabililor persoane juridice, precum și a celor care desfășoară activități independente și profesii liberale, că va intra în vigoare ordinul ANAF care clasifică plătitorii de taxe în funcție de risc, precum și un nou cadru legal pentru activitatea de control fiscal cu scopul de a combate mai eficient evaziunea la nivel național, dar și transfrontalier. Tot în anul următor, Antifrauda fiscală și ITM vor avea un plan comun de acțiune vizând firmele cu risc fiscal ridicat, dar și pentru cele cu risc de a utiliza muncă la negru sau gri.
Până atunci, o serie de modificări au fost deja aprobate prin OUG 130/2021, pe care le voi recapitula pe scurt. OUG nr. 130/2021 a adus modificări și completări atât Codului fiscal, cât și altor acte normative, precum Legea nr. 241/2005 pentru prevenirea și combaterea evaziunii fiscale, OUG nr. 120/2021 privind factura electronică RO e-Factura, Codul muncii, Legea nr. 296/2020 și OUG nr. 226/2020, privind unele măsuri fiscale, Codul de procedură fiscală.
Noutăți în Codul fiscal în 2022
Valoarea cadourilor în bani și/sau în natură, inclusiv tichetele-cadou, care pot fi acordate de angajatori și sunt neimpozabile, cu diverse ocazii speciale se majorează de la 150 de lei la 300 lei. Totodată, tichetele cadou vor putea fi acordate doar propriilor salariați ai angajatorilor, nu și altor persoane fizice, ca până acum, în cadrul campaniilor de marketing, studiul pieței, promovarea pe piețe existente sau noi, pentru protocol, pentru reclamă și publicitate. Mai mult, tichetele cadou se cuprind în baza lunară de calcul al contribuțiilor sociale obligatorii doar dacă sunt oferite cu ocaziile speciale și în limitele prevăzute de lege. Ocaziile speciale pentru care sunt oferite tichete-cadou angajaților și pentru copiii minori ai acestora sunt: ziua de 8 martie, ziua de 1 iunie, Paștele, Crăciunul.
Pensionarii nu mai sunt exceptați de la plata CASS pentru veniturile din pensii pentru venitul care depășește suma de 4.000 lei lunar inclusiv, pentru fiecare drept de pensie. Venitul impozabil lunar din pensii se stabilește prin deducerea sumei neimpozabile lunare de 2.000 lei și a CASS datorate, dacă este cazul.
Măsura suspendării plății unor sume de către angajator pentru educația timpurie a copiilor angajaților se prelungește până la data de 31 decembrie 2022 inclusiv.
Se introduce, de la 1 ianuarie 2022, cota redusă de TVA de 5% pentru livrarea de locuințe care au o suprafață utilă de maximum 120 mp, exclusiv anexele gospodărești, a căror valoare, inclusiv a terenului pe care sunt construite, depășește suma de 450.000 lei, dar nu depășește suma de 700.000 lei, exclusiv TVA, achiziţionate de persoane fizice în mod individual sau în comun cu altă persoană fizică/alte persoane fizice. Cota redusă se aplică numai în cazul locuințelor care în momentul livrării pot fi locuite ca atare și pentru o singură locuință ce îndeplinește condițiile de mai sus.
Alte noutăți legislative cu impact fiscal
Facturile electronice se vor emite obligatoriu prin RO e-Factura în cazul comercializării produselor cu risc fiscal ridicat comercializate în relația B2B, începând cu 1 iulie 2022. Pentru perioada 1 aprilie – 30 iunie 2022, furnizorii de produse cu risc fiscal ridicat pot transmite facturile emise în sistemul național RO e-Factura, indiferent dacă destinatarii sunt sau nu înregistrați în Registrul RO e-Factura. Lista produselor cu risc fiscal ridicat va fi definitivată prin ordin ANAF în 30 de zile de la intrarea în vigoare a OUG 130/2021.
În Codul muncii se completează dispozițiile legale referitoare la aplicabilitatea salariului de bază minim brut pe țară, respectiv se prevede că acesta poate fi acordat unui salariat pentru o perioadă de maximum 24 de luni de la data semnării contractului individual de muncă. După această perioadă salariatul va fi încadrat cu un salariu de bază superior salariului de bază minim brut pe țară. Vor beneficia de aceste măsuri și salariații încadrați cu salariul de bază minim brut pe țară, care au deja încheiate contracte individuale de muncă cu o durată de peste 24 de luni.
În ce privește amnistia fiscală, se prelungește termenul de depunere a cererilor de anulare a obligațiilor fiscale accesorii aferente obligațiilor fiscale principale cu scadențe anterioare datei de 31 martie 2020 (inclusiv cele rezultate din inspecții fiscale) de la data de 31 ianuarie 2022 la data de 30 iunie 2022.
